Patterns with permission to sell?

    Patterns with permission to sell?
    on: July 25, 2011, 09:48:34 AM
Hi there!  I wonder if anyone can point me in the right direction.

It is so hard to find patterns that you are allowed to make and sell.  I don't want to steal anyone's work; I want to do this the right way.  But where are these patterns?  Surely not every hand-sewn thing on Etsy is that person's original pattern.

Is there a listing out there that I'm missing?   Cheesy

    Thanks!
    Rachel

I don't know much about the rights issues surrounding patterns- my guess is you probably have a lot of leeway, but it's good to be respectful and careful.

Keyka Lou patterns specifically states that patterns can be used to make and sell merchandise, but you do need to need to credit that the pattern maker. She creates wonderful patterns!

I'd be curious to learn more about this issue as well.

If I were you, I would just ask.  There are several pattern makers on etsy that tell you how many you can make to sell or will sell you a limited license to make and sell a certain amount.

I know there's a TON of different schools of thought on this, but most lawyers will tell you that you can sell from any patterns. You can't sell the pattern itself but pattern makers have no grounds to say you CAN'T sell items made from their patterns. It's YOUR labor, materials, and interpretation of the pattern. They can't legally enforce asking you not to sell it.

Correct me if I'm wrong, but if the pattern has a copyright, you can make a small change to it somehow such as add a ruffle, a tuck, a dart, etc, and now it is no longer the EXACT pattern but yours.  I think that gives you permissions.

            Happy Sewing!

The way I understand this issue, if a pattern has a copyright, you cannot sell a finished product from the pattern legally. I know the larger and even some of the smaller pattern companies specifically state you cannot produce their product for sale.

I've done a little research on this issue, and from what I read, you cannot just add a ruffle or some minor adjustment and call that pattern your own.  The exact wording I remember was that your "creation" cannot be recognizable as the pattern you used if it is a copyrighted pattern.

                Hope this helps
